Terms of Service

Please read these terms carefully before using our services

Welcome to Dutch Test Canada ("DTC," "we," "our," or "us"). By accessing our website or using our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

1. Company Role and Services Description

Dutch Test Canada operates as an administrative intermediary that works with licensed practitioners who are authorized to order DUTCH™ (Dried Urine Test for Comprehensive Hormones) testing services. DTC is not a laboratory, medical provider, or licensed clinical practice.

Our role as an intermediary includes:

  • Facilitating the sale and distribution of DUTCH™ urine sample collection kits
  • Coordinating with independently contracted licensed practitioners who place laboratory orders on behalf of clients
  • Arranging for the processing of samples through Precision Analytical, Inc. laboratory
  • Delivering test results and comprehensive reports to clients
  • Coordinating optional practitioner interpretation and consultation services through independent contracted practitioners

2. Practitioner Services and Lab Ordering

Dutch Test Canada contracts with independently licensed healthcare practitioners ("Contracted Practitioners") to place laboratory orders on behalf of clients. These practitioners operate under their own professional licenses, insurance, and scope of practice.

By using our services, you understand and agree that:

  • Lab orders are placed by independently contracted licensed practitioners, not by DTC directly
  • Contracted Practitioners exercise their own independent clinical judgment when placing lab orders
  • DTC serves as an administrative intermediary to coordinate between clients, Contracted Practitioners, and the laboratory
  • The practitioner-client relationship for lab ordering purposes exists between you and the Contracted Practitioner, not between you and DTC
  • DTC does not control, direct, or supervise the clinical decisions of Contracted Practitioners

3. Important Health Disclaimer

Dutch Test Canada provides administrative and coordination services only. DTC is not a medical provider, laboratory, or licensed clinical practice, and our services do not constitute medical advice, diagnosis, or treatment.

Specifically:

  • Test results and reports are for informational purposes only
  • Results should not be used to diagnose or treat any medical condition
  • You should always consult with a qualified healthcare provider of your choosing before making any health-related decisions
  • Any interpretations provided through our service are general information, not personalized medical advice
  • Do not discontinue any medication or hormone therapy based on test results without consulting your healthcare provider
  • Hormone testing results should be interpreted in the context of your complete health picture by a qualified professional

4. Eligibility and Restrictions

To use our services, you must:

  • Be at least 18 years of age, or have a parent/legal guardian consent on your behalf
  • Be a resident of Canada (for shipping purposes)
  • Have the legal capacity to enter into contracts
  • Provide accurate and complete information

Minors Under 18: Patients under the age of 18 require the parental/guardian consent form to be completed electronically when a lab order is placed by non-licensed clinicians. Parents or legal guardians must consent and take responsibility for any testing ordered on behalf of a minor.

Geographic Restrictions: We do not support lab ordering for patients located in New York (NY), New Jersey (NJ), or Rhode Island (RI). Orders originating from or intended for residents of these states will not be processed.

5. Consent Requirements

Before accessing payment and placing an order, you are required to provide the following consent:

"I verbally consent to the DUTCH® Test Canada team ordering and handling lab work and I consent to allow the lab to communicate with me via email regarding my health information."

By providing this consent, you acknowledge and agree that:

  • DTC, through its Contracted Practitioners, will place a laboratory order on your behalf
  • The laboratory (Precision Analytical, Inc.) may communicate with you directly via email regarding your health information and test results
  • You authorize the transmission of your personal and health information as necessary to facilitate the testing process
  • You understand DTC acts as an intermediary and is not the ordering practitioner

6. Orders and Payment

Pricing: All prices are displayed in Canadian Dollars (CAD) and include applicable taxes. Prices are subject to change without notice, but changes will not affect orders already placed.

Payment: Payment is required at the time of order. We accept major credit cards and other payment methods as displayed at checkout. All payments are processed securely through our third-party payment processor. Payment is made to Dutch Test Canada as the intermediary; it is not a payment to the Contracted Practitioner or the laboratory directly.

Order Confirmation: After placing an order, you will receive an email confirmation. This confirmation does not guarantee fulfillment; orders are subject to product availability, consent validation, and geographic eligibility verification.

7. Sample Collection and Submission

You are responsible for:

  • Following the sample collection instructions provided in your kit carefully
  • Collecting samples at the specified times throughout the day
  • For DUTCH™ Cycle Mapping: collecting samples on the correct days of your menstrual cycle
  • Returning your samples within 14 days of collection
  • Ensuring samples are from the individual who will receive the results
  • Properly drying samples before shipping as instructed

Invalid Samples: If your samples are insufficient or invalid for testing, we will contact you to arrange a replacement kit. Additional fees may apply for multiple replacement kits.

8. Test Results and Reports

Delivery: Test results are typically delivered within 2-3 weeks of receiving your samples at the laboratory. Results are sent via email in PDF format.

Accuracy: While Precision Analytical maintains high standards of accuracy, DTC cannot guarantee that results are error-free. DTC does not perform laboratory analysis and is not responsible for laboratory errors. Test results reflect hormone levels at the time of collection.

Interpretation: Optional practitioner analysis through our Contracted Practitioners provides interpretation based on established reference ranges and hormone patterns but should not be considered medical advice.

9. Practitioner Analysis Services

Optional practitioner consultations are provided by independently contracted licensed practitioners and are:

  • Educational and informational in nature
  • Not a substitute for professional medical advice from your own healthcare provider
  • Provided under the Contracted Practitioner's own professional license and scope of practice
  • Subject to scheduling availability
  • Valid for 90 days from results delivery

10. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Dutch Test Canada or our licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

DUTCH® and DUTCH™ Test® are registered trademarks of Precision Analytical, Inc. Dutch Test Canada works with licensed practitioners who are authorized to order DUTCH™ tests. Dutch Test Canada is not affiliated with or endorsed by Precision Analytical, Inc. Use of these marks on this site is for the purpose of identifying the testing services facilitated through our platform.

11. Limitation of Liability and Separation of Responsibility

To the maximum extent permitted by law:

  • DTC's Role: Dutch Test Canada acts solely as an administrative intermediary working with licensed practitioners. DTC is not responsible for clinical decisions, laboratory processes, or practitioner actions
  • Practitioner Liability: Contracted Practitioners who place lab orders are independently licensed professionals responsible for their own clinical decisions, actions, and omissions. Any claims relating to the clinical appropriateness of a lab order are between you and the ordering Contracted Practitioner
  • Laboratory Liability: Precision Analytical, Inc. is solely responsible for the accuracy and processing of laboratory analysis. DTC does not perform any laboratory testing
  • DTC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services
  • DTC's total liability for any claim shall not exceed the amount you paid to DTC for the specific service giving rise to the claim
  • DTC is not liable for any health outcomes, decisions, or actions you take based on test results or reports

12. Indemnification

You agree to indemnify and hold harmless Dutch Test Canada, its officers, directors, employees, agents, and Contracted Practitioners from any claims, damages, losses, or expenses arising from your use of our services, violation of these Terms, or your reliance on test results for medical decisions.

13. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the sharing of your personal and health information with Contracted Practitioners and the laboratory as necessary to fulfill your order.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our services after changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of British Columbia.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
