These Terms are an agreement between you and Real Health Diagnostics inc., a company incorporated in British Columbia, Canada, with its business address at 5307 Victoria Drive #1343, Vancouver, British Columbia V5P 3V6, Canada, operating as HTMA Test, DUTCH Test and GI-MAP Test ("we", "us", "our").

Our Privacy Policy, Refund Policy and Shipping Policy form part of these Terms and are incorporated by reference.
We sell at-home laboratory test kits and the analysis of samples you collect yourself, together with written interpretation of your results where you have purchased it.

How the order is placed. For DUTCH and GI-MAP testing we act as your ordering practitioner: the laboratory accepts the sample on the authority of our order rather than directly from you. This is why we ask for date of birth and biological sex, and it is part of the reason samples cannot be accepted from certain states (see clause 4.3).
By placing an order you consent to your sample and the personal information associated with it being transferred to and processed by the relevant laboratory, including in the United States. How we handle that information is described in our Privacy Policy.
Our services are for informational and educational purposes only. They are not a medical diagnosis, and they are not a substitute for the advice of a licensed healthcare professional.
We do not diagnose, treat, cure or prevent any disease. Nothing we provide should be used to start, stop or change any treatment or medication. Always consult a qualified healthcare provider about your health, and seek immediate medical attention for urgent symptoms — do not wait for test results.
4.1 You must be at least 18 years old, or ordering as the parent or legal guardian of the person the test is for.
4.2 You must provide accurate information about yourself or the person tested, including date of birth and biological sex where requested, since results are interpreted against reference ranges that depend on them.
4.3 Laboratory acceptance restrictions. Because of state laws governing direct-to-consumer laboratory testing, our partner laboratories cannot accept samples from residents of New York, New Jersey or Rhode Island, and no laboratory paperwork may list an address in those states. If you are a resident of, or provide a shipping or mailing address in, one of those states, we cannot provide the service and will refund your order in full. You confirm at checkout that you are not ordering from a restricted state.
4.4 We serve customers in Canada and the United States. We do not currently accept orders from other countries.
Prices are shown in the currency indicated at checkout and include applicable taxes where stated. Payment is processed by Stripe; we do not store your card details.
Each test is for one person. If you order more than one, you will be asked for each person's details after payment.
Test accuracy depends on you following the collection instructions we send you. You are responsible for collecting the sample as instructed, completing the laboratory submission form accurately, and posting the sample to the laboratory within any timeframe stated in your instructions.
If a sample is insufficient, contaminated, incorrectly labelled, or arrives in a condition the laboratory cannot process, a repeat test may be required. See our Refund Policy for what happens in that case.
Results are typically available 10–14 days after the laboratory receives your sample. This is an estimate, not a guarantee. Postal delays, customs processing and laboratory volumes can extend it.
To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to these Terms or the services is limited to the amount you paid for the order giving rise to the claim.
We are not liable for indirect or consequential loss, or for any decision you or anyone else makes on the basis of your results. Nothing in these Terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud.
These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to its conflict-of-law provisions, and you agree to the exclusive jurisdiction of the courts of that province.
Nothing in these Terms limits any consumer-protection right you have under the laws of your place of residence that cannot be waived by agreement.
We may update these Terms. The version in force when you place an order is the one that applies to that order. Material changes will be posted on our websites with a revised date.
